A good article (” Tech Firms Pitch Tools for Sifting Legal Records “) from the Wall Street Journal hammers out some of the tension between automated e-discovery tools and the hesitancy of lawyers and law firms to embrace “the machines.” In reading the piece, Carolyn Elefant on the Legal Blog Watch was reminded of John Henry , the steel-drivin’ man who beat a steam-powered machine in hammering railroad spikes, but died in the process. Ron Friedmann believes that the article “oversimplifies the issue” of “lawyers trying to protect their billable hours, … but does alert corporate managers (think CFOs and CEOs) … to more cost-effective ways to approach litigation.” Like Ron, I’m just glad to see coverage of the topic in the WSJ. The WSJ piece reports on how HP, Xerox, EMC, and IBM have jumped into the market of providing automated solutions for collecting, preserving and producing ele...

Jordan Goddard was irritated when his Internet access started fading in and out. It had been down for hours the day before. When his cable TV went out too, he fired up his blog. “Dear Comcast,” the West Virginia University senior wrote. “You suck.” When a member of Comcast Corp.’s new cyberteam called a few days later, Goddard assumed the company was threatening a lawsuit. But the worker was calling to apologize and offer help. Goddard was amazed. “T... more

Patchwork E-Discovery in the States
From: feeds.feedburner.com
Post Date: 2008-01-08 19:01:27

Another article from the Law Technology News’ EDD Showcase is my own survey of how electronic discovery is getting handled in the various states. Because the information for each state could change at any time, I’m sure some of the info might be out of date soon. So to compensate, I provide a few resources in the article for staying informed about state e-discovery activity. I quote heavily from Thomas Allman in my article who follows the e-discovery activity quite clos... more

Law Technology News has published their January 2008 EDD Showcase . There are several great articles as always and I’ll do a separate post for each one that I want to comment upon. First up, e-discovery sage and scholar Michael Arkfeld writes about the confusion of communication involved in e-discovery. This confusion manifests itself most notably in the "meet & confer" sessions when lawyers try to understand the technical terms necessary for a successful meeting. What I like m... more

While the story doesn’t directly involve a litigation matter, the IntraLinks video “ 45 Days to Find a White Knight ” provides a splendid example of how an online, virtual dataroom can facilitate the distribution of documents between clients and outside counsel. The story recounts how Carl Icahn announced a hostile takeover bid of Fairmont Hotels & Resorts , which prompted the Fairmont shareholders to frantically shop around for a better deal. The professionally produce... more
Caution: Lawyers Using Technology Ahead
From: feeds.feedburner.com
Post Date: 2008-01-03 21:52:41

The Post Process e-discovery blog links to a story on Boston.com entitled “ Lawyers Try To Catch Up in Tech World ” which is a nice, general story about how technology has become critical to the legal world, even though the profession has “resisted” it for many years. The piece quotes Randi Mayes, the bellwether leader of ILTA , as well as Henry Chace who is still an active volunteer in ILTA and CIO of Burns & Levinson LLP in Boston. The article discusses sev... more
