There has been a lot of discussion and a lot of fear among photographers regarding potential orphan works legislation. A major problem with current copyright law is that it does not provide a way to use a creative work that has been abandoned (no entity can be found to claim ownership). The premise behind an “orphan works” addition to copyright law is that it would provide a means for anyone to make use of copyrighted material that no longer has an owner. It works by limiting damages that can be claimed if the work truly falls under orphan works protection. If a person wants to use a work they must ask permission from the copyright holder just as they do now. Under the current law, if they can’t find the owner they are out of luck. Lessig : The biggest loser in this whole battle is the Orphan Works legislation. If anyone needed evidence to demonstrate that it is WAY TOO EARLY for Congress to be passing massive new bureaucratic overlays to copyright to deal with the important problem of "orphan works," this is the evidence. Let's let this private alternative develop, while Congress puts away its billion-factor balancing tests for regulating access to "orphan works." ... more

I am sad to hear that the Orphan Works Bill was passed by the Senate. Really sad. In a guest article on Crafts of Texture blog, Pamela Baker points out: The Illustrator’s Partnership in answer to this atrocity, is what they call Plan B: The Orphan Works Opposition. They propose that we contact Congress now to stop the House Judiciary Committee from the final adoption of this Bill. Illustrators Partnership has developed a number of sample letters that you can use to communicat... more

I have five friends who have birthdays in late May/early June and are photography enthusiasts so I have been keeping an eye open for gift ideas. So far, through random stumbling about on the internet I have come across these rather cool looking photo-related gadgets: Keyboard shortcut skins for Photoshop, Aperture, Final Cut Pro, Pro Tools, After Effects, & Logic Pro. They’re $30 for laptops, $40 for desktops at Photojojo although they’re only available for Macs. Giotto... more

Saw this amazing new-to-me video of people being punched in the face this morning (via Waxy ). ( More footage here .) High-speed photography, to me, is amazing. Typically we photographers deal in stills but the line between photography and video is blurring. Manufacturers have been adding video capability to still cameras and vice versa for a long time. Photographers have been known to spend ungodly amounts of time putting together video from still frames. And very slow ... more

My photo blog (shameless plug: lightproofbox.com ) has been getting some traffic from StumbleUpon lately which brings with it little waves of attention. 99% of it is positive. But invariably there are a few people who don’t seem to have anything better to do than to say trite, mean things (anonymously, natch). Hey, I’ve been around long enough to know there are jackasses out there who, while not doing anything risky or creative of their own, will always be wil... more
